Terms of Service

These Terms of Service ("Terms") govern your use of the Companion AI mobile application and related services (the "App"), operated by Companion AI Team ("we", "us", "our"), based in Germany. By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App. You can reach us at support@companionsai.org.

1. What the App is

Companion AI provides an AI-powered companion you can chat and roleplay with. Responses are generated by artificial intelligence using third-party AI models. The App is intended for entertainment, companionship, and general conversation.

Your companion is software, not a person. Every message, image, and personality trait it presents is generated by AI. It has no feelings, no real-world life, and no awareness of you beyond the information stored in your account, even when it writes as though it does. The App may also send you proactive messages — such as daily check-ins, follow-ups on events you have added, and reminders if you have not chatted in a while — as push notifications. These are automatically generated too. You can turn check-ins off in the App and notifications off in your device settings.

Important — not professional advice. Companion AI is not a healthcare, medical, mental-health, legal, or financial service, and it does not provide professional advice. AI-generated responses may be inaccurate, incomplete, or unsuitable for your situation — do not rely on them as fact or as professional guidance. The App is not for emergencies. If you are experiencing a medical or mental-health emergency, or think you may harm yourself or others, stop using the App and contact your local emergency number (112 in the EU) or a crisis hotline immediately.

2. Eligibility

You must be at least 18 years old to use the App. By using it, you confirm that you are 18 or older. We do not knowingly allow anyone under 18 to use the App, and we will terminate accounts we believe belong to minors.

3. Your account

You are responsible for your account and for keeping your login credentials secure. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account.

4. Subscriptions, billing, and refunds

The App offers a free tier with usage limits and an optional paid subscription ("Premium") that unlocks additional features and higher limits.
Both tiers are subject to fair-use caps — for example daily limits on messages, generated images, and uploads — which we apply to keep the service affordable and available, and which we may adjust over time.
Subscriptions are sold and billed through the Apple App Store or Google Play, according to the price shown at purchase. Payment is charged to your app-store account.
Subscriptions renew automatically until cancelled. You can manage or cancel your subscription any time in your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period.
Refunds are handled according to the policies of the app store you purchased through. EU/EEA consumers: you have a statutory 14-day right of withdrawal for digital content; however, by starting to use paid digital content immediately, you request immediate performance and acknowledge that you lose this right of withdrawal once delivery begins, except where the content is defective or the law provides otherwise.
Prices and subscription features may change; we will not change the price of an active billing period you have already paid for.

5. Acceptable use

You agree not to use the App to:

break any applicable law, or encourage or facilitate illegal activity;
create, request, or configure content that sexualizes minors, or that depicts, describes, or simulates any identifiable real person without their consent (including configuring a companion to impersonate a real person);
generate or distribute content that is unlawful, harassing, hateful, defamatory, or that infringes others' rights;
attempt to disrupt, reverse-engineer, overload, or gain unauthorized access to the App or its systems;
use the App for any commercial resale of its outputs or access, except as we expressly permit.

We may suspend or terminate accounts that violate these Terms, with or without notice.

6. Your content and AI outputs

You retain your rights to the content you submit ("your content"). You grant us the limited licence needed to store, process, and transmit your content to operate the App — including sending it to third-party AI providers to generate responses and images (see our Privacy Policy). You are responsible for your content and for how you use AI-generated outputs. Because outputs are generated by AI and can be similar for different users, we cannot guarantee they are unique, accurate, or free of third-party rights.

To keep your companion consistent between conversations, the App automatically derives short factual notes ("memories") from your chats and stores them on your account. You can review, edit, and delete these at any time in the App.

Feedback. If you send us feedback, suggestions, or bug reports, you allow us to use them to improve the App without any obligation or payment to you. You keep any rights you already had in what you sent.

7. Intellectual property

The App itself — its software, design, and branding — belongs to us or our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use, subject to these Terms.

8. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, secure, or that AI outputs will meet your expectations. Nothing in these Terms excludes or limits rights you have as a consumer under mandatory law.

9. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the App. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for intent or gross negligence, or for any other liability that cannot be limited under German or EU law.

10. Termination

You may stop using the App and delete your account at any time from within the App (Account → More account options → Delete account), which permanently removes your data as described in the Privacy Policy. If you would rather clear your conversations, memories, stories, and profile details but keep your account, use the in-app Reset option instead. Our deletion page sets out exactly what each option removes. We may suspend or terminate your access if you breach these Terms or where required by law. Deleting your account ends any free-tier use; paid subscriptions must also be cancelled through your app store to stop renewals.

11. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, notify you in the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. App store terms

You acknowledge that these Terms are between you and us only — not with Apple or Google. Apple and Google are not responsible for the App or its content, and have no obligation to provide support for it. Where you obtained the App through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with the applicable app-store terms of use.

13. Governing law

These Terms are governed by the laws of Germany, excluding its conflict-of-laws rules, and without depriving you of the mandatory consumer protections of the country where you live. Disputes are subject to the competent courts, subject to any mandatory consumer jurisdiction rules that apply to you.
